Introduction

  1. Web Site Owner. Jenny Blake Enterprises, LLC (“JBE”) is the owner of pivotmethod.com (the "Site)"). JBE can be contacted by e-mail at hello [at] pivotmethod.com. This online privacy notice discloses JBE’s information practices for this Site, including what type of personal identifiable information is requested in order to make a purchase, how the information is used, and with whom the information is shared. 

  2. Web Site Visits. In general, you can visit on the Site without disclosing any personal information. The Site does keep track of the domains from which people visit us, then analyzes the data gathered from Site visits for trends and statistics, and discards the gathered data.

  3. Web Site Transactions. At times, JBE will need personal information regarding a customer or a prospective customer. For example, to process an order, JBE may need to know a customer's name, mailing address, e-mail address and credit card details. It is JBE’s intent to inform you before we collect personal information, such as user's name and/or address on the Internet. If you tell us that you do not wish to have this information used as a basis for further contact with you, JBE will respect your wishes.

Privacy Policy Details

Personal Information That May Be Collected:

  1. Identifying Information. In order to make a purchase or to access designated subscriber services and/or restricted areas within the Site, JBE will request a user to provide certain personal identifying information, which may include: your name, postal address, e-mail address, user name, password, telephone number, method of payment, and, if applicable, credit card number. JBE may request additional information necessary to establish and maintain customer's account.

  2. Service Quality Monitoring. Some Site transactions may require a customer to telephone JBE, or JBE to call the customer. JBE will not contact you by telephone without your prior consent, except to confirm an order placed online and/or to inform a customer of the status of such order. Customer should be aware that it is JBE's practice to monitor, and in some cases record such calls for staff training or quality assurance purposes.

  3. Lost or Stolen Information. If a customer's credit card and/or password is lost or stolen, the customer should promptly notify JBE in order to enable JBE to cancel the lost or stolen information and to update its records with a changed credit card and/or password.

  4. Links to Other Web Sites. The Site may contain links to other web sites. JBE is not responsible for the privacy practices or the content of those other Web sites.

Uses Made of the Information:

  1. Limited Uses Identified. Without customer's prior consent, JBE will not use your personal identifiable information for any purpose other than that for which it is submitted. JBE uses personal identifiable information to reply to inquiries, handle JBE also processes billing and business requests related to the Site participation.

  2. Marketing Uses. Unless customer opts out as herein provided, JBE reserves the right to provide customer with information about JBE’S Site, JBE’s products and services, and related information in which customer has indicated an interest.

  3. Stored Information Uses. JBE stores and retains the information provided by customer described in the Privacy Policy for as long as the customer uses JBE’S services or as necessary to fulfill the purpose(s) for which it was collected, provide JBE’S Services, resolve disputes, establish legal defenses, conduct audits, pursue legitimate business purposes, enforce JBE’S agreements, and comply with applicable laws. This information is used to compile a customer's purchase history in order to enable JBE to recommend products, services, or special offers that would be of interest to a customer, to support customer interaction with the Site; to deliver customer purchases; and/or to contact customer again about other JBE’s services and products.

Disclosure of the Information:

  1. Within Corporate Organization. JBE may share your personal information within JBE corporate organization, and may transfer the information to countries in the world where JBE conducts business. Some countries may provide less legal protection for customer personal information. In such countries JBE will still handle customer personal information in the manner describe herein.

  2. Mergers and Acquisitions. Circumstances may arise where for business reasons, JBE decides to sell, buy, merge or otherwise reorganize its businesses in the United States or some other country. Such a transaction may involve the disclosure of personal identifying information to prospective or actual purchasers, and/or receiving such information from sellers. It is JBE’S practice to seek appropriate protection for information in these types of transactions.

  3. Agents. JBE employs or engages other companies and individuals to perform business functions on behalf of JBE. These persons are provided with personal identifying information required to perform their functions, but are prohibited by contract from using the information for other purposes. These persons engage in a variety of functions which include, but are not limited to, fulfilling orders, delivering packages, removing repetitive information from customer lists, analyzing data, providing marketing assistance, processing credit card payments and providing customer services.

  4. Affiliated Businesses. JBE works closely with affiliated businesses operating web site stores, providing services or selling products on each other's Web sites. These businesses identify themselves to customers. Customer information related to a transaction with an affiliated business is shared with that affiliated business.

  5. Marketing Analysis by Third Parties. JBE reserves the right to disclose to third parties personal information about customers for marketing analysis; however, any information disclosed will be in the form of aggregate data that does not describe or identify an individual customer. JBE reserves the right to disclose and/or share any personal information JBE may collect with our third-party service providers. The categories of service providers to whom we entrust personal information include service providers for: (1) the provision of the Services; (2) the provision of information, products, and other services you have requested, (3) marketing and advertising, 4) payment and transaction processing, (5) customer service activities; and (6) the provision of IT and related services.

  6. Disclosure to Governmental Authorities. Under certain circumstances, personal information may be subject to disclosure pursuant to a judicial or other government subpoenas, warrants or orders.

  7. Referral or Shared Content. When a customer requests JBE’s referral services to forward and/or share certain content with a friend, such as an email inviting a friend to our Services or sharing certain content from the Services with a friend, your personal information may be shared. 

  8. Disclosures for Self-Protection or to Protect Others. JBE may access, preserve, and/or disclose any information stored in association with a customer to external parties if JBE, believes in good faith, to be doing so is required and/or appropriate to: (1) comply with law enforcement or national security requests and legal process, such as a court order or subpoena; (2) protect customer, JBE’s, or other’s rights property, or safety; (3) enforce JBE’s policies or contracts; (4) collect amounts owed to JBE; or (5) assist with an investigation and prosecution of suspected or actual illegal activity. 

Use of Computer Tracking Technologies:

  1. No Tracking of Personal Information. JBE’S Site(s) are not set up to track, collect or distribute personal information not entered by visitors. Through web site access logs JBE does collect clickstream data and HTTP protocol elements, which generate certain kinds of non-identifying site usage data, such as the number of hits and visits to our sites. This information is used for internal purposes by technical support staff for research and development, user analysis and business decision making, all of which provides better services to the public. The statistics garnered, which contain no personal information and cannot be used to gather such information, may also be provided to third parties.

  2. Use of Cookies. JBE, or its third-party vendors, collects non-identifiable and personal information through the use of various technologies, including "cookies". A cookie is an alphanumeric identifier that a Web site can transfer to customer's hard drive through customer's browser. The cookie is then stored on customer's computer as an anonymous tag that identifies the customer's computer, but not the customer. Cookies may be sent by JBE or its third-party vendors. Customer can set its browser(s) to notify customer before a cookie is received, giving an opportunity to decide whether to accept the cookie. Prospective customer(s)/Customer(s) may opt-out and set its browser(s) to turn off cookies; however, some Web sites may not then work properly.

  3. Use of Web Beacon Technologies. JBE may also use Web beacon or other technologies to better tailor its Web site(s) to provide better customer service. If these technologies are in use, when a visitor accesses these pages of the Web site, a non-identifiable notice of that visit is generated which may be processed by JBE or by its suppliers. Web beacons usually work in conjunction with cookies. If customer does not want cookie information to be associated with customer's visits to these pages, customer can set its browser to turn off cookies; however, Web beacon and other technologies will still detect visits to these pages, but the notices they generate cannot be associated with other non-identifiable cookie information and are disregarded.

  4. Collection of Non-Identifiable Information. JBE may collect non-identifiable information from user visits to the Site(s) in order to provide better customer service. Examples of such collecting include: traffic analysis, such as tracking of the domains from which users visit, or tracking numbers of visitors; measuring visitor activity on Site(s); Web site and system administration; user analysis; and business decision making. Such information is sometimes known as "clickstream data." JBE or its contractors may use this data to analyze trends and statistics.

  5. Collection of Personal Information. JBE collects personal identifying information from customer during a transaction. JBE may extract some personally identifying information about that transaction in a non-identifiable format and combine it with other non-identifiable information, such as clickstream data. This information is used and analyzed only at an aggregate level (not at an individual level) to help JBE understand trends and patterns. This information is not reviewed at an individual level.

  6. Social and Interactive Features. JBE’S website may include social media features such as the Facebook “Like” button and LinkedIn (that may include widgets such as the share this button or other interactive mini-programs). These features may collect your IP address, which page you are visiting on our site, and may set a cookie to enable the feature to function properly. These social media features are either hosted by a third party or hosted directly on our website. Prospective customer/customer interactions with these features are governed by the privacy policy of the company providing it. 

  7. JBE may use Google Analytics and Google Analytics Demographics and Interest Reporting to collect information regarding visitor behavior and visitor demographics on some of JBE’S services and to develop website content. JBE’S uses this information to improve.

Information Security:

  1. Commitment to Online Security. JBE employs physical, electronic and managerial procedures to safeguard the security and integrity of personal information. Billing and payment data is encrypted whenever transmitted or received online. Personal information is accessible only by staff designated to handle online requests or complaints. 

  2. No Liability for Acts of Third Parties. JBE will exercise all reasonable efforts to safeguard the confidentiality of customer personal information. However, transmissions protected by industry-standard security technology and implemented by human beings cannot be made absolutely secure. Consequently, JBE shall not be liable for unauthorized disclosure of personal information due to no fault of JBE including, but not limited to, errors in transmission and unauthorized acts of JBE staff and/or third parties. In the event that personal information is compromised as a result of breach of security, JBE will promptly notify those whose personal information has been compromised as may be required by applicable law. 

Privacy Policy Changes and Opt-Out Rights

  1. Changes to Privacy Policy. This privacy notice was last updated on October 15, 2021. JBE reserves the right to update its privacy policy statement at any time. A notice of any material change will be posted on the Site home page for thirty (30) days prior to the implementation of such change. 

  2. Opt-Out Right. Customer and/or prospective customer has the right at any time to cease permitting personal information to be collected, used or disclosed by JBE and/or by any third parties with whom JBE has shared and/or transferred such personal information. After processing the cancellation, JBE will delete customer or prospective customer's personal information from its database. This will impact customer’s ability to receive goods and services from JBE.

It is JBE’S policy to provide notifications, whether such notifications are required by law or are for marketing or other business related purposes, to users via email notice, written or hard copy notice, or through conspicuous posting of such notice on the website, as determined by JBE in its sole discretion. JBE reserves the right to determine the form and means of providing notifications to customers. By providing JBE with the user/customer’s email address the user/customer consents to JBE using such email address to send you notices in lieu of postal mail. JBE may also use a user/customer’s email address to send other messages, including changes to JBE’S features and special offers. 

Prospective customer/customer may opt out of certain notifications by using the unsubscribe link found at the bottom of each email, to opt-out of receiving future emails, changing account settings, or by sending an e-mail to hello [at] lifeaftercollege.org. JBE will process such a request within a reasonable time after receipt of the request. Prospective customer/customers that opt-out may not receive messages regarding updates, improvements, or special offers, and may not opt-out of certain types of notices, including, but not limited to, announcements regarding certain products, support of the Site or Services and other notices as may be required by law. If prospective customer/customer has provided any third party with personal information, prospective/customer will have to contact such third party directly with any opt-out request. 

Do Not Track (“DNT”) is a privacy preference that users can set in certain web browsers. DNT is a way for users to inform websites and services that they do not want certain information about their webpage visits collected over time and across websites or online. Please note that we do not respond to or honor DNT signals or similar mechanisms transmitted by web browsers.

International Privacy Laws:

By using this website, prospective customers/customers understand and agree that JBE will transfer data to the United States. By choosing to visit JBE’S website, utilize the services or otherwise provide information to JBE, the prospective customer/customer agrees that any dispute over privacy or the terms contained in this Privacy Policy will be governed by the laws of the State of New York and the United States and the adjudications of any disputes arising in connection with JBE or the website will be in accordance with the User Agreement. 

If prospective customer/customer is visiting from the European Union or other regions with laws governing data collection and use, please note that you are agreeing to the transfer of your information to the United States and to processing of your data globally. By providing your personal information, you consent to any transfer and processing in accordance with this Privacy Policy.

  1. Questions, Problems and Complaints. If you have a question about this policy statement, or a complaint about JBE’S compliance with this privacy policy, you may contact JBE by e-mail at hello [at] lifeaftercollege.org. 

  2. Terms of Use. If customer chooses to enter into a purchase order, customer's action is hereby deemed acceptance of JBE practices described in this policy statement. Any dispute over privacy between customer and JBE is subject to the provisions of this notice and to JBE’S Terms of Use Agreement which is hereby incorporated herein and which can be read here.

  3. JBE may amend this policy at any time. This privacy policy inures to the benefit of successors and assigns of JBE.
